GENERAL PROVISIONS
These terms and conditions are valid exclusively between the company GYPS s.r.l., with registered office in Via Elia Enrico, 8 - 20851 Milan (MI), REA number 1962257, VAT number 07491030966, hereinafter ''GYPS'', and any person who makes online purchases on the www.gyps.it website, hereinafter ''CUSTOMER''. These terms and conditions may be amended and their publication date on the website is the date when they enter into effect. These terms and conditions govern purchases made on the website www.GYPS.it, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Leg. Decree no. 206/2005, amended by Leg. Decree no. 21/2014 and by Leg. Decree no. 70/2003 on e-commerce.
Subject-matter of the Contract
With these terms and conditions of sale, GYPS sells and the CUSTOMER purchases remotely products manufactured by it and marketed for finishing of the interiors indicated and offered for sale on www.gyps.it. The contract is concluded exclusively via the Internet, through the CUSTOMER accessing the website www.gyps.it and submitting a purchase order using the procedure envisaged by said website. The customer agrees to view these terms and conditions of sale before confirming the order, particularly the pre-contractual information provided by GYPS and to accept them by flagging the box indicated.
Pre-contractual information for the consumer - art. 49 of leg. decree 206/2005
Before concluding the purchase contract, the CUSTOMER must view the features of the products illustrated on the individual product cards selected. Before concluding the purchase contract and before confirming the order with “obligation of payment”, the CUSTOMER is informed of: - the total price of the products including tax, with details of shipment costs and all other costs; - payment methods; - the deadline within which GYPS agrees to deliver the goods; - terms, conditions and procedures for exercising the right of withdrawal (art. 7 of these terms and conditions); - information that the CUSTOMER must pay the cost to return the products in the case of withdrawal; - existence of the legal warranty on conformity of the products purchased; - conditions of after sales assistance and sales warranties provided by GYPS. The CUSTOMER may, at any moment and before concluding the contract in any case, obtain information on GYPS, its geographical address, telephone and fax number, e-mail address, information which is provided hereunder: GYPS S.R.L. registered office Via E. Conclusion and efficacy of the contract. Orders and estimates.
The contract of sale is considered as accepted when GYPS sends an e-mail confirming the order to the CUSTOMER. The e-mail contains the CUSTOMER'S data and the order number, the price of the merchandise purchased, the shipping costs and the delivery address to which the merchandise will be sent. The CUSTOMER agrees to check that the personal data contained in it is correct and to send any corrections immediately via e-mail to: ordiniweb@gyps.it.

ORDERS - BUYING ON LINE IS SIMPLE
1. Select All Products or the sections dedicated to Gyps Light, Inspection hatches, Passive fire protection, Preformed solutions in plasterboard on the Home Page. 2. Find the product which interests you. The product page contains detailed images, the technical data sheet, recommendations for use to assist you in choosing your purchase. N.B. Not all articles are purchasable on line, due to dimensions and heavy weight, but it is possible to request an estimate. We will respond as soon as possible and assess with you the best solution and offer. 3. Choose the article and quantities and add the product to the shopping cart. You can choose to proceed with the order or continue shopping. 5. You must LOGIN or register to complete the order. 6. After login, you can view the transport cost for the delivery address you have indicated and choose the payment method: credit card or bank credit transfer. Where possible, we recommend using a credit card for payment: the commission is generally lower and the order confirmation is sent immediately to our warehouse. 10. Accept the General Terms and Conditions of Sale and confirm the order. 11. You will receive an e-mail containing the order confirmation.

ESTIMATES

The product page contains detailed images, the technical data sheet, recommendations for use to assist you in choosing your purchase. 3. Choose the article and quantity and request an estimate. 5. You must LOGIN or register to request an estimate. 6. After login, your estimate request will be transmitted to the GYPS staff, who will respond with 48/72 hours of receiving the request.
Description of the products
GYPS agrees to describe and present the articles sold on the website as well as possible. However, there may be slight differences between the website and the actual product, since GYPS works continually and constantly to improve and optimise its products. If the CUSTOMER decides to cancel the order and terminate the contract, GYPS will refund the amount paid within 14 days from the day when GYPS learns of the customer's decision to terminate the contract.
Payment methods
Each payment by the CUSTOMER may be made solely via: Credit card: the amount of the order will be charged and the merchandise shipped within 24/48 hours of receiving the e-mail confirming the order. Bank credit transfer: the orders will be fulfilled on receiving payment, on average after 3 days. GYPD will cancel the order if the bank credit transfer has still not been received 7 days after the order acceptance date. The products will only be shipped when the full agreed amount has been received, in all cases. Paying on line with credit card: 1. We accept all credit cards, including prepaid cards, on the following circuits: Visa, Mastercard, Maestro, American Express, Visa Electron, Diners and CartaSi. CREDIT CARD IMAGE 2. When you reach the Payment step, select the "Credit cards" option, read and accept the General Terms and Conditions of Sales, then confirm the order. 3. You will be redirected to the Pay Way payment platform, where you can enter your card details (holder, card number, expiry date and CVC/CVV security code on the back of the card - last 3 figures for Visa and Mastercard). 4. A window in which to enter your Secure Code will appear if your card provides this. (Contact your card issuer for more details). 5. When the order is made, the cash is RESERVED on the card. The payment will be made and the amount charged within 24/48 hours of receiving the e-mail confirming the order. 6. When you purchase on gyps.it, your payment is totally secure, as it is managed using an SSL certified data encryption protocol. Payment takes place directly on the intermediary's server, so gyps.it does not have access to the credit card details at any moment. Communications on payment and the data communicated by the CUSTOMER takes place on specific protected lines. The security of Credit Card payments is guaranteed by the PAYWAY secure server and the SSL (Secure Sockets Layer) security protocol, which allows electronic payments to be made on the Internet in total security. Paying on line with a bank credit transfer: 1. When you reach the Payment step, choose Bank Credit Transfer. 2. You will receive an e-mail confirming creation of the order and containing all the information needed to make the bank credit transfer. 3. Make the bank credit transfer payable to Gyps s.r.l., IBAN IT 92 X 07090 24212 0020 101 53549 SWIFT CCRT IT 2TMAL and enter the order number (GYPS WEB xxxxxx) as the REASON FOR PAYMENT. 4. Please send the bank credit transfer receipt to: ordiniweb@gyps.it. 5. Our warehouse receives the order confirmation when payment is received. 6. Your order will be shipped within 48/72 hours of payment being received.
Prices
All sale prices of the products indicated on www.gyps.it are expressed in Euro and excluding VAT. VAT and shipping costs are not included in the purchase price and are indicated and calculated when the order is concluded, before making payment. The CUSTOMER accepts the right of GYPS to change its prices at any time, but the merchandise will be invoiced at the prices indicated on the website at the moment when the order is made and confirmed in the e-mail sent by GYPS to the CUSTOMER. In the case of computer, manual or technical errors or those of any other nature which could result in a substantial change in the sale price, unintended by GYPS, which makes it exorbitant or clearly too low, the purchase order will be considered as invalid and cancelled and the amount paid by the CUSTOMER will be refunded as soon as possible after the cancellation date (max 14 days).
Right of withdrawal
GYPS grants a consumer who is dissatisfied for any reason the right of withdrawal as provided by current regulations, without any penalty and without the need to specify the reason. This right may only be exercised by final users, so all purchases made for reasons related to business or professional activities, i.e. where a VAT number is entered on the order form, will not be covered by this right. This right may be exercised within 14 working days of receipt. If the right of withdrawal is exercised via e-mail, it must also be confirmed via registered letter with acknowledgement of receipt, sent to the address indicated above within the following 48 hours. IMPORTANT. The letter indicating the intention to exercise the right of withdrawal must also indicate the details of a bank or post office current account into which to credit the amount due (IBAN, account holder). For this right to be exercised: the Customer must express the intention of exercising the right of withdrawal in the methods described above the product purchased must be unused, undamaged and returned in the original packaging, complete in all parts. Adhesive labels or tape must not be placed directly on the original packaging of the product; the product must be returned in the times and with the methods indicated above. The CUSTOMER is fully liable for the redelivery costs and the transport risks for return of the articles. If the merchandise is damaged during transport, GYPS will inform the Customer of what has happened (within the 5th day of receiving the merchandise at its warehouses), to allow the customer to submit a claim to the delivery service chosen and obtain a refund on the value of the merchandise (if insured); GYPS may not be held liable in any way for damage or theft/loss of merchandise returned with uninsured shipping; shipment, up until receipt at our warehouse, is under the full liability of the Customer. Cash on delivery or carriage forward payments will not be accepted under any circumstances. On arrival (at the warehouse), the merchandise will be examined to check for any damage or tampering not caused by transport. With the exception of any expenses to rectify ascertained damage to the original packaging, GYPS will refund the entire amount already paid to the Customer, excluding shipping costs, within 14 days of receiving the merchandise. GYPS will refund the amount due via bank credit transfer into the current account you indicate to our staff. The right of withdrawal is entirely forfeit if the essential condition of the merchandise being undamaged (packaging and/or contents) is not satisfied, in cases in which GYPS discovers: the original internal and/or external packaging is missing; integral elements of the product are missing (accessories, parts, etc.); damage to the product for any reason. use of the product, including partial use for products with customised packaging or clearly customised. If the right of withdrawal is forfeit, GYPS will keep the merchandise available for 72 hours, after which it will be destroyed. IMPORTANT: the right of withdrawal is not applied to orders for custom products, since they have been manufactured entirely with the measurements, characteristics and types expressly requested by the customer, obviously with the exception of malfunctions or objective manufacturing defects attributable to GYPS.
Warranty and damaged products
Products purchased via the GYPS website are subject, insofar as applicable, to the regulations contained in Leg. Decree no. 24 dated 2.2.2002 (Off. Gaz. no. 57, 8.3.2002), on sale contracts and on warranties on consumer goods and, for anything not contemplated therein, the specific provisions provided by the Italian Civil Code. This warranty will apply to a product with defects in conformity or damage found at the moment of purchase, provided said product has been used correctly and with due diligence and in accordance with its intended use and the indications in any technical documentation, in compliance with the various operating rules indicated therein. Said warranty will not be applicable in the case of negligence, improper use or tampering with the product. Any damage to the products must be indicated on receiving the merchandise and communicated via e-mail within 24 hours. The written notice must be attached by the customer on reshipping the disputed product. Even if damaged, the product must, at the moment of reshipping, be complete with its original packaging and any documentation received by the customer upon purchase in order to be replaced. GYPS cannot replace a product which has been reshipped without the original packaging and documentation. Reship products to the following address: GYPS S.r.l. Via Pomposa, 53, 47924 Rimini (RN). GYPS reserves the right to check for any damage claimed by the CUSTOMER and only to replace the product after said check has been carried out. The request will only be satisfied if the returned package contains the following documents: order number and date and a brief description of the defect found. The CUSTOMER is responsible for paying the costs of returning the merchandise.
Delivery methods and transport
GYPS accepts orders for delivery throughout the national territory and abroad, using a trusted delivery service at a single rate. The products will be delivered via express delivery service to the address indicated by the CUSTOMER on making the order, within 5/7 days of the date when the CUSTOMER receives the e-mail confirming the order from GYPS. If GYPS is unable to make the delivery as promised, the CUSTOMER will be informed and the new shipment date indicated. The CUSTOMER will have 48 hours to cancel the order. GYPS will issue an invoice on the merchandise purchased for each order made on www.gyps.it. The invoice is available and printable, after the order has been fulfilled, in the reserved section of the customer's own orders. The invoice will contain the information provided by the CUSTOMER during the purchasing procedure. The data can no longer be changed once the invoice has been issued. Shipping costs vary according to weight/volume. Order processing and preparation time is approximately 24 hours starting from the working day after the order/payment is received, during which the orders received are processed and prepared for shipment. In the case of orders with partial or total unavailability of the merchandise, the CUSTOMER will be contacted immediately by the Gyps staff via e-mail and the product production times indicated, which are 48/72 hours on average. The delivery service delivers from Monday to Friday, between 8.30 a.m. and 6 p.m. In order to make delivery easier, we always give the customer's telephone number to the delivery service, but it is recommended to indicate an address at which someone is always present on weekdays and during the delivery times. If no one is present at the address provided the first time, the delivery service will make a second attempt at delivery. After this, the package will be held at the closest warehouse. The customer will be contacted again to agree on a new delivery date. The merchandise travels at the purchaser's risk, so customers are informed that any claim for damage of the merchandise must be made immediately on receiving the merchandise, signing the receipt with reservation and indicating the type of damage and sending photographs of the merchandise via e-mail (ordiniweb@gyps.it) with the order reference data, within 24 hours of receiving the merchandise. The CUSTOMER can contact the GYPS Technical Office for any assembly problems or requests for information, advice and/or solutions.
Liability
GYPS accepts no liability for disservices relating to transport or caused by force majeure or chance, including those caused by malfunctions or disservices of the Internet.
Access to the site
The CUSTOMER is entitled to access the website for consultation and to make purchases. Use of the website and its contents in any other form is not permitted. All elements of the website remain the property of GYPS and are protected by intellectual property rights.
Completeness
These General Terms and Conditions of Sale are formed of all the clauses they contain. If one or more of these General Terms and Conditions of Sale is considered to be invalid or declared as such according to laws or regulations or on the basis of a decision of a court with jurisdiction, the other provisions will continue to be fully valid and effective.
Applicable law and court of competent jurisdiction
These General Terms and Conditions of Sale are subject to Italian law. Any dispute which cannot be settled amicably will be submitted to the sole jurisdiction of Rimini Court. In any case, it is possible to apply the mediation procedure referred to in legislative decree 28/2010 for settlement of any disputes which arise over the interpretation or fulfilment of these terms and conditions of sale.
